Eine Familie aus SyrienThe individual’s lawsuit against the EU border control agency Frontex has been unsuccessful in the Court of the European Union. The judges ruled that the potential damages suffered could not be directly attributed to the actions of Frontex. Additionally, Frontex is not responsible for reviewing return decisions or asylum applications. Therefore, the agency cannot be held liable for compensation.
The family of six arrived in Greece in 2016. According to the EU court, they expressed their intention to apply for asylum there. A few days later, they were flown back to Turkey in a joint return operation conducted by Greece and Frontex.
The family currently residing in Iraq complains that Frontex acted unlawfully. Their asylum application should have been examined before they were taken out of the EU. Additionally, Frontex violated the prohibition of degrading treatment and disregarded the right to effective legal protection and the rights of children. They demanded over 100,000 euros in compensation.
The judges did not follow this. The agency’s only task in the return operations is to provide technical and operational support to EU member states. The ruling can still be appealed to the highest court of the EU, the European Court of Justice.

Die Anwältin der Familie, Lisa-Marie Komp, bezeichnete das Urteil als unbefriedigend. Die Richter hätten klargestellt, dass die Verantwortung für die Einhaltung der Menschenrechte allein bei den EU-Staaten liege. Gleichzeitig werfe das Urteil Fragen auf: Es bleibe unklar, in welcher Weise Frontex die Einhaltung der Menschenrechte überwachen müsse.
Frontex wird von Nichtregierungsorganisationen immer wieder vorgeworfen, die Rechte von Geflüchteten nicht ausreichend zu schützen. Vergangenes Jahr hatte der frühere Frontex-Chef, der Franzose Fabrice Leggeri, nach schweren Vorwürfen gegen ihn und Mitarbeiter seinen Posten zur Verfügung gestellt. Hintergrund waren insbesondere Ermittlungen zu illegalen Zurückweisungen von Migranten im Mittelmeer.
