The government plans to establish a „Freedom Commission“ that is expected to begin its work in 2025. This information is based on key points prepared by Marco Buschmann (FDP) from the Federal Ministry of Justice. The commission will primarily review laws regarding the work of the police, customs, and intelligence agencies, and this will be done before they are presented to the cabinet.
According to information from SPIEGEL, the commission should ensure a „respectful and proportionate design of intervention powers“ during their examination. Additionally, they should consider how they align with existing laws „in terms of democracy and freedom.“

The security authorities should be obligated to provide information to the committee. In the case of projects from other areas, the commission should be able to give an opinion if they involve „significant restrictions on fundamental rights.“
Herzensanliegen der FDP
The Bundestag could also commission the independent work of the committee. According to the concept, 18 honorary members would be appointed based on recommendations from the government and the Bundestag. Potential candidates could include legal scholars, experienced lawyers, and experts from NGOs who specialize in German security architecture.
Für die FDP ist die »Freiheitskommission« ein Herzensanliegen aus dem Koalitionsvertrag der Ampel. Das von Nancy Faeser (SPD) geführte Bundesinnenministerium sieht die Pläne skeptisch. Das Gremium dürfe nur eine beratende Funktion haben, heißt es aus dem Ministerium. Eine »formale Integration in den Gesetzgebungsprozess« komme nicht infrage.
